General Terms and Conditions (GTC)

This is a courtesy translation. In case of any discrepancy, the German version of these Terms and Conditions shall prevail.
1. Scope of these General Terms and Conditions
These General Terms and Conditions (“GTC”) of Funke Kulinarik AG govern all orders, deliveries and services made via the online shop www.manufakturfunke.ch.
The online shop is operated by Funke Kulinarik AG, 9410 Heiden (Switzerland).
By placing an order, the customer accepts the version of these General Terms and Conditions valid at the time of the order. The provisions of the Swiss Code of Obligations (CO) and other applicable Swiss laws and ordinances apply in addition.
2. Offers and Conclusion of Contract
All offers in the online shop are non-binding. The purchase contract is concluded when the customer clicks the button “Order with obligation to pay” or “Pay with Twint” in the electronic ordering process. Orders may alternatively be placed by phone, e-mail or in writing.
Obvious typing, pricing or calculation errors entitle Funke Kulinarik AG to withdraw from the contract. Price lists, brochures and online publications are subject to change.
3. Prices, Shipping and Payment
All prices are in Swiss francs (CHF), including statutory VAT.
Any shipping costs are shown separately during the ordering process.
Prices in the online shop may differ from those in the physical shop. There is no entitlement to retrospective price adjustments.
Payment methods and conditions are shown in the online shop. Order processing is automated via e-mail. The customer is obliged to provide a correct e-mail address and ensure receipt of messages.
4. Delivery and Deadlines
Deliveries are made to all postal addresses in Switzerland. For shipments abroad, Funke Kulinarik AG will contact the customer to clarify shipping, tax and customs costs.
Orders are usually dispatched within 24 hours.
In the event of delivery delays, the customer will be informed and may withdraw from the contract in writing within ten days.
Funke Kulinarik AG is entitled to make partial deliveries; any additional costs arising from this are borne by the seller. If delivery cannot be made due to an incorrect address or refusal of acceptance, the customer bears the costs of the unsuccessful delivery.
5. Performance of Contract and Transfer of Risk
The order confirmation issued by Funke Kulinarik AG is decisive. Benefit and risk pass to the customer upon dispatch of the goods, unless otherwise agreed.
6. Retention of Title and Payment Terms
The goods remain the property of Funke Kulinarik AG until full payment has been received. Registration in the retention-of-title register remains reserved.
In the event of late payment, default and reminder fees may be charged (from the second reminder: CHF 10.–). The seller may declare outstanding claims immediately due, demand securities, or execute deliveries against advance payment only.
7. Warranty
Demonstrable defects will be remedied by replacement delivery or rectification. If this fails, the customer may demand a price reduction or withdraw from the contract.
Excluded from the warranty is damage resulting from improper handling, wear and tear, force majeure or interventions by third parties.
The seller accepts no liability for customer reviews or product descriptions provided by third parties.
8. Right of Return
Goods may be returned within 14 days. Returns are only accepted if the goods are intact and unopened and accompanied by the delivery note. Opened food products and spices are excluded from return. Postage costs will be reimbursed upon proof.
9. Liability
All claims by the customer, regardless of legal basis, are conclusively governed by these General Terms and Conditions.
Funke Kulinarik AG is liable only for intent and gross negligence. Any further liability – in particular for consequential damages or loss of profit – is excluded to the extent permitted by law.
10. Data Protection
Funke Kulinarik AG treats all customer data confidentially and does not pass it on to third parties. Further information can be found in our Privacy Policy and in the legal notice.
11. Severability and Amendments to these General Terms and Conditions
Should any provision of these General Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected.
Amendments or additions must be made in text form (e-mail is sufficient).
Deviating contractual terms of the customer apply only if accepted in writing. With every order, the customer accepts the currently valid version of these General Terms and Conditions.
12. Place of Jurisdiction and Applicable Law
The place of jurisdiction is Heiden (AR).
Swiss law applies exclusively, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).
The parties shall endeavour to settle any disputes amicably.
13. Delivery Area and Shipping
We deliver to Switzerland and Liechtenstein as well as to Germany and Austria.
A minimum order value of CHF 50 applies to deliveries to Germany and Austria. There is no minimum order value within Switzerland and Liechtenstein.
Shipping costs within Switzerland and Liechtenstein are CHF 9.00 per order; from an order value of CHF 30, shipping is free; kitchen tools (e.g. spice mills) are excluded and do not count towards the CHF 30 order value. Shipping to Germany and Austria costs CHF 15.00. The amounts shown in the cart are authoritative.
Deliveries to Germany and Austria may be subject to customs and import duties. These are borne by the recipient.
All product labels are in German.
